These Terms of Use ("Terms") are a binding agreement between you and SoundSafe Kids ("SoundSafe Kids," "we," "us," or "our") governing your use of the SoundSafe Kids mobile app and the SoundSafe Kids website at soundsafe.kids (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
If you use the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
SoundSafe Kids provides noise monitoring and hearing safety tools for parents and caregivers to help protect children's hearing. Features may include real-time noise measurement, guided safety checks, child profiles, place tracking, and recommendations.
Features and availability may vary by app version, plan tier, region, operating system version, and hardware capabilities.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on compatible devices you own or control, solely for your lawful internal use.

If you download the App from Apple, your use is also subject to Apple's applicable terms, including Apple Media Services terms and standard app license terms.
Apple is not responsible for the Service itself, support, maintenance, or claims relating to the Service except as required by law. To the extent required by Apple's program terms, Apple and its subsidiaries are third-party beneficiaries of these Terms.
During beta or early access periods, features may change, be interrupted, or be removed without notice. We may add usage limits, update entitlement rules, or end beta access at any time.
Any beta incentives, including temporary plan upgrades, are promotional and may be modified or discontinued.
Nothing in these Terms is intended to limit any non-waivable rights you may have under applicable consumer law. If a mandatory local law gives you rights that conflict with these Terms, the mandatory law controls to the extent of that conflict.
If local law provides a right to cancel or withdraw from a purchase, that right applies only to the extent required by applicable law and subject to any lawful exceptions.
California residents may have rights under the California Consumer Privacy Act and other consumer protection laws. Nothing in these Terms is intended to waive any non-waivable right provided by California law.
To the extent permitted by law, any waiver of class actions, jury trials, or similar procedural rights will be interpreted narrowly and only where enforceable.
Some jurisdictions provide additional consumer protections regarding subscriptions, auto-renewals, refunds, warranty disclaimers, or limitations of liability. Those protections apply to the extent required by local law and may supplement or limit these Terms.
SoundSafe Kids may offer free and paid subscription tiers. Current plan options and pricing are shown in-app and may also be shown on our Website.
If you reinstall the App or move to a new device, you can use available restore-purchase functionality to recover eligible entitlements.
You agree to use the Service lawfully and responsibly. You may not use the Service to violate law, infringe rights, or endanger people or property.
You must not misrepresent Service outputs as certified, legally authoritative, or professionally calibrated results where those claims are not true.
Service outputs are intended for practical operational guidance and comparative analysis. Output quality can vary with device hardware, acoustic environment, signal conditions, microphone placement, and calibration state.
The Service is not intended as a substitute for systems that require certified, traceable, or legally mandated calibration and documentation.
You retain ownership of your Local App Data, including measurements, profiles, and session history. As described in our Privacy Policy, this data is designed to remain on your device.
You are responsible for your own backup practices and for securing access to your device.
If you submit ideas, suggestions, or feedback about the Service, you grant SoundSafe Kids a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate that feedback without compensation to you, unless prohibited by law.
The Service, including software, interface design, text, graphics, branding, logos, and all related intellectual property rights, is owned by SoundSafe Kids or its licensors and is protected by applicable law.
Except for the limited license in these Terms, no rights are granted to you by implication, estoppel, or otherwise.
The Service may depend on or link to third-party services (such as app stores, payment systems, hosting infrastructure, and external websites). We do not control third-party services and are not responsible for their content, availability, or terms.
If you believe content on the Website infringes your intellectual property rights, contact us at support@soundsafe.kids with sufficient detail for us to investigate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
We do not promise that the Service will be uninterrupted, error-free, secure, or that defects will always be corrected promptly. Some jurisdictions do not allow certain warranty exclusions, so the above disclaimer applies only to the extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUNDSAFE KIDS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OR DAMAGE THAT IS NOT A DIRECT AND PROXIMATE RESULT OF OUR BREACH, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SALES, LOST GOODWILL, LOST DATA, DATA CORRUPTION, DEVICE FAILURE, BUSINESS INTERRUPTION, BUSINESS OPPORTUNITY LOSS, REPLACEMENT COSTS, OR PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SOUNDSAFE KIDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUNDSAFE KIDS' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS, DAMAGES, LOSSES, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE, THESE TERMS, OR ANY USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SOUNDSAFE KIDS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50.
THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW AND ARE A FUNDAMENTAL PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND SOUNDSAFE KIDS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY EXCLUSIONS OR LIMITATIONS, SO THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LOCAL LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING, WHERE APPLICABLE, LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY A PARTY'S NEGLIGENCE.
You agree to defend, indemnify, and hold harmless SoundSafe Kids and its affiliates, officers, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the Service, (b) your violation of these Terms, or (c) your violation of law or third-party rights.
You may stop using the Service at any time by uninstalling the App and ceasing use of the Website.
We may suspend or terminate access to all or part of the Service if we reasonably believe you violated these Terms, created legal risk, or abused the Service.
Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations, indemnity, dispute provisions, and miscellaneous legal terms.
You represent that you are not located in, organized in, or ordinarily resident in a country or territory subject to comprehensive embargoes applicable to the Service, and that you are not on any applicable restricted-party list. You agree to comply with all export control and sanctions laws applicable to your use of the Service.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to applicable law, any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue there.
We may revise these Terms from time to time. Updated Terms become effective when posted, unless a different effective date is stated. Continued use of the Service after updates means you accept the revised Terms.
